Terms of Service

1. Acceptance of Terms

By accessing and using BookTranslator ("Service"), provided by Lovin, LLC ("Company", "we", "our", or "us"), you ("User" or "you") agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

The Service translates books and documents (EPUB, PDF, DOCX, and other supported formats) into other languages using third-party AI models, while preserving formatting and layout wherever possible. Features, supported formats, and output options may change as the Service evolves.

3. Accounts, Registration, and Privacy

Some purchase flows can be used as a guest, while features such as task history, credits, and subscriptions require an account. You are responsible for keeping your account credentials secure and for the activity that occurs under your account. Our Privacy Policy, incorporated herein by reference, explains how we collect and use data.

4. User Responsibilities

You represent and warrant that you own or have the necessary rights to the content you submit to the Service for translation, and you are responsible for compliance with applicable copyright laws. A translation is a derivative work of the source material: receiving a translated file does not grant you the right to distribute or publish content you do not own the rights to.

5. Intellectual Property Rights

The Service, including its underlying software and technology, is the intellectual property of the Company. You retain ownership of the files you upload and of the translated output generated for you; the Company claims no ownership over your content. We process your content only to provide the Service, including translation, storage, and delivery. We do not use your files or translated output to train AI models.

6. Fees, Credits, and Subscriptions

The Service is a paid product. Depending on your workflow, you may pay through a one-time checkout for an individual translation, purchase credit packages, or subscribe to a plan that includes monthly credits. The price is always shown before you confirm a purchase. Payments are processed by Stripe. Subscriptions renew automatically at the end of each billing period until canceled; you can cancel at any time, and cancellation takes effect at the end of the current billing period.

7. Refunds

If a paid translation task fails, we may provide a refund or a credit adjustment based on the payment flow used for that task. If you have a concern about translation quality or another issue, contact us at support@booktranslator.app with your task ID and a description of the problem; we review these requests case by case.

8. Prohibited Conduct

You may not:

• Use the Service to translate content that is illegal, infringes on any third party's rights, or is otherwise objectionable.
• Reverse engineer, decompile, or disassemble the Service.
• Resell or redistribute the Service or any part of it.
• Use automated means to abuse the Service, disrupt its operation, or attempt to bypass usage limits or payment.

9. Disclaimers

The Service relies on AI models, and translations may contain errors or inaccuracies. The Service and its output are provided "as is": the Company does not guarantee that the Service will be error-free or uninterrupted, and makes no warranties regarding the accuracy or reliability of translations. For important use cases, review the output before relying on it.

10. Limitation of Liability

The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service. In any event, the Company's total liability arising out of or relating to the Service shall not exceed the amount you paid to the Company in the twelve (12) months preceding the claim.

11. Amendments

The Company reserves the right to amend these Terms at any time. Changes will be posted on this page with an updated Effective Date, and continued use of the Service after any such changes shall constitute your consent to such changes.

12. Termination

The Company may suspend or terminate your access to the Service for breach of these Terms, including violations of the prohibited conduct rules or applicable law.

13. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the jurisdiction where the Company is established. Any disputes arising from these Terms will be exclusively resolved in the courts of that jurisdiction.
